Agreement
These Terms of Service (“Terms”) govern your access to and use of nebriae.com and related products operated by Nebriae LLC (“Nebriae”, “we”, “us”), including the nɛb.raɪ.ə iOS instrument and the Campfire web experience (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy.
License to use the Services
Subject to your compliance with these Terms, Nebriae grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. All rights not expressly granted are reserved.
Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction). If using the Services on behalf of an organization, you represent that you have authority to bind that organization.
Accounts
You are responsible for your account and for safeguarding credentials. You agree to provide accurate information and notify us of unauthorized use.
User Content
You retain ownership of content you submit (“User Content”). By submitting User Content, you grant Nebriae a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate and provide the Services.
You represent that you have the rights necessary to submit your User Content.
Acceptable use
You agree not to misuse the Services, including:
- Harassment, hate, threats, or unlawful conduct.
- Infringing intellectual property rights.
- Unauthorized system access or data extraction.
- Uploading malware or exploiting vulnerabilities.
- Automated scraping or abusive bot activity.
Intellectual property
The Services, including design, code, branding, and software (excluding User Content), are owned by Nebriae or its licensors and are protected by intellectual property laws.
Certain technologies and methods are marked “Patent Pending.” This indicates a filed patent application and does not guarantee issuance.
Disclaimers
The Services are provided “as is” and “as available.” Nebriae disclaims all warranties to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Nebriae will not be liable for indirect, incidental, consequential, or punitive damages, or loss of profits or data.
Indemnification
You agree to indemnify and hold harmless Nebriae from claims arising out of your use of the Services or violation of these Terms.
Modifications
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance.
Governing law & venue
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the state or federal courts located in California.
Severability & entire agreement
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and Nebriae regarding the Services.
